Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Opero, the Restaurant Operating System provided by TackOn LLC (“Opero,” “we,” “us”). By creating an account or using the service, you agree to these Terms. If you are using Opero on behalf of a business, you represent that you are authorized to bind that business.
1. The service
Opero provides restaurant operations software — point of sale, self-order kiosk, QR and table ordering, kitchen display, menu management, inventory, CRM, loyalty, reporting, and embedded payment processing. Opero is hardware-agnostic; you provide your own tablets, and we provide a payment device per location. Features available to you depend on your subscription plan.
2. Subscriptions & billing
Opero is billed as a recurring subscription per active location, at the price for your plan shown on our pricing page. Subscriptions are month-to-month unless otherwise agreed. Unless required by law or stated otherwise, fees are non-refundable, and adding or removing a location changes your recurring charge accordingly. You authorize us to charge your payment method on file for each billing period until you cancel. If a charge fails, access may be suspended after a dunning period.
3. Payments processing
Card payments you accept from your guests are processed through our embedded payments provider and its sponsor bank. Funds settle to the bank account you provide during onboarding, net of applicable processing and platform fees. You are responsible for the accuracy of your business and banking information, for compliance with card-network rules and applicable law, and for the goods and services you sell. Chargebacks, refunds, and disputes are your responsibility as the merchant.
4. Devices
Opero runs on tablets you own. You may connect unlimited devices at no additional per-device charge; subscription pricing is per location. You are responsible for your devices, networks, and keeping your account credentials secure.
5. Acceptable use
You agree not to use the service for unlawful activity, to process payments you are not authorized to accept, to infringe others’ rights, to reverse-engineer or resell the service, or to attempt to disrupt or gain unauthorized access to the service. We may suspend or terminate accounts that violate these Terms.
6. Your data
Your use of Opero is also governed by our Privacy Policy. You retain ownership of your business and customer data; you grant us the rights needed to operate and improve the service. You are responsible for obtaining any consents required to collect your guests’ information through the service.
7. Disclaimers & limitation of liability
The service is provided “as is” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, TackOn LLC will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the fees you paid for the service in the three months preceding the claim.
8. Termination
You may cancel at any time; cancellation stops future billing and ends access at the end of the current period. We may suspend or terminate the service for non-payment or violation of these Terms.
